Staged corrective measures for universities in breach of the law
The voluntary efforts of universities form the basis of maintenance and improvement of the quality of university education and research, but it is necessary for the national government to take corrective measures as necessary directed at universities in breach of the law in order to protect students and so on. Previously shutdown orders for the university as a whole were stipulated as corrective measures by the Minister of Education, Culture, Sports, Science and Technology, but under the November 2002 School Education Law amendment, the following three staged corrective measures were newly regulated: 1) improvement recommendation; 2) modification order; and 3) order to abolish the organization, for example the faculty.
Because it is necessary to take sufficiently into account the independence of universities, the Minister of Education, Culture, Sports, Science and Technology must make a submission to the Council for the Establishment of Universities and School Corporations and receive a report before applying these corrective measures.
